In brief
- These Terms apply to everyone who visits bidshakti.in or uses the BidShakti portal or mobile app, whether on a trial or a paid plan.
- BidShakti is software. It finds tenders on the portals we cover, checks them against your documents and helps you prepare. It does not guarantee any result.
- Always verify a tender on the official portal before relying on it, and review every AI output before you submit anything.
- Paying subscribers are also bound by the Subscriber Agreement. Refunds follow the Refund Policy.
- Indian law applies, and the courts at Ahmedabad, Gujarat have jurisdiction.
This summary is for convenience. The numbered sections below are the binding text.
1. Who these Terms are between
- 1.1These Terms of Use ("Terms") are an agreement between AveoSoft Private Limited, a company incorporated under the Companies Act, 2013 with CIN U72900GJ2021PTC123833 and its registered office at 616 Sharan Circle Business Hub, Zundal, Ahmedabad, Gujarat 382424 ("AveoSoft", "we", "us"), and the person or entity that uses the Service ("you").
- 1.2"Service" means the website at bidshakti.in, the BidShakti portal (the web application through which subscribers work, located at app.bidshakti.com and at the workspace address assigned to each subscriber), the BidShakti mobile app, and the support we provide for them.
- 1.3BidShakti is a product and trade name of AveoSoft. References to BidShakti mean AveoSoft.
2. Acceptance and eligibility
- 2.1You accept these Terms when you use any part of the Service, create an account, start a trial, or click to accept them. If you do not agree, do not use the Service.
- 2.2You must be at least 18 years old. The Service is for businesses and is not directed at children.
- 2.3If you use the Service for a company, firm, LLP, society or other entity, you confirm that you are authorised to bind it, and "you" includes that entity.
- 2.4Acceptance recorded electronically has the same effect as a signature under the Information Technology Act, 2000.
3. Related documents
- 3.1The Privacy Policy explains how we handle personal data and forms part of these Terms.
- 3.2Paying subscribers are also bound by the Subscriber Agreement. If these Terms and the Subscriber Agreement differ on fees, billing, refunds, term, termination, data export or liability, the Subscriber Agreement prevails.
- 3.3Refunds are governed by the Refund Policy. Account deletion follows the Account Deletion page.
4. What the Service does and does not do
- 4.1The Service collects tender information published on the sources listed in Section 5, filters it against the criteria you set, provides AI-assisted analysis, Go/No-Go verdicts, competitor and price information and document drafting, and stores your own bid records.
- 4.2The BidShakti software never submits a bid, and no submission is ever made from BidShakti systems. The software does not pay fees or deposits or act as your agent before any buyer, and it does not need your GeM, e-procurement portal or digital signature certificate credentials to work.
- 4.3Under BidShakti Assist, our team helps you submit your bid on the official procurement portal (GeM or the relevant state portal), using your own portal account and credentials. Its scope and any fees are agreed with you in writing, and that written engagement governs anything our team does on your behalf.
- 4.4We give no legal, financial, tax, technical or regulatory advice, and we do not promise that any bid will qualify or win.
- 4.5AveoSoft and BidShakti are not affiliated with, endorsed by or authorised by the Government of India, any State Government, GeM, CPPP, any e-procurement portal or any buyer. Their names are used only to identify the source of information.
5. Coverage limits
- 5.1Tender information is collected only from these sources ("Covered Sources"): the Government e-Marketplace (GeM), the Central Public Procurement Portal (CPPP), the State and Union Territory e-procurement portals listed in the BidShakti portal from time to time, and nProcure in Gujarat.
- 5.2A tender published only on another source, such as a newspaper, a notice board, a portal we do not list or a buyer's own website, will not appear in the Service.
- 5.3Information is collected by automated means at intervals. It is not a live mirror or an official feed, and it may be incomplete, delayed, duplicated or out of date. Corrigenda, extensions and cancellations may reach the Service late or not at all.
- 5.4The Covered Sources are the only authoritative record. Before you rely on any tender, date, fee, deposit, eligibility condition or corrigendum, you must check it on the official portal.
- 5.5What you see depends on the departments, keywords, categories and regions you set. Narrow settings show fewer tenders. Keeping your settings accurate is your responsibility.
6. Accounts and security
- 6.1Give accurate information when you register and keep it current.
- 6.2Keep your credentials confidential and do not share one login between people. You are responsible for activity under your credentials.
- 6.3Tell us promptly at contact@bidshakti.com if you suspect any misuse of your account.
- 6.4We will never ask for your GeM, e-procurement portal or digital signature certificate passwords. Treat any such request as fraud and report it to us.
7. AI output
- 7.1Analyses, verdicts, summaries, checklists, price bands and drafted documents produced by the Service ("AI Output") are decision support only.
- 7.2AI Output can be wrong, incomplete or out of date. It may misread a document, miss a condition or misjudge eligibility.
- 7.3A competent person on your side must check every AI Output against the official tender documents before anything is submitted or relied upon. By submitting a document prepared with the Service, you adopt it as your own.
- 7.4A Go/No-Go verdict is a software opinion, not an assurance of eligibility or a prediction of award. A price band is an estimate from past data, not a recommendation to quote any figure.
- 7.5Generated documents use only the letterhead and signature images you upload. If you upload no signature image, a blank signature space is left for you to sign. We never apply a signature you have not provided, and never use one subscriber's branding in another subscriber's documents.
8. Acceptable use
- 8.1Use the Service only for your own lawful business of finding, assessing and preparing bids.
- 8.2You must not scrape, bulk download or systematically copy any part of the Service; resell, republish or share its data with third parties; probe or access another subscriber's workspace; bypass security, rate or usage limits; reverse engineer the Service except where law permits; or use it to build a competing product.
- 8.3You must not use the Service to prepare false or forged documents, misstate your turnover, experience or certifications, or take part in bid rigging, collusion or bribery.
- 8.4A breach of this Section is a material breach and may lead to immediate suspension or termination.
9. Intellectual property
- 9.1AveoSoft owns the Service, including its software, design, workflows, prompts, templates and the BidShakti name and marks, and our arrangement and presentation of tender information.
- 9.2You own the content you upload. You give us a limited licence to host, process and display it only to provide, secure and support the Service for you and to comply with law.
- 9.3We grant you a limited, non-exclusive, non-transferable licence to use the Service for your internal business while your access continues.
- 9.4If you send us feedback, we may use it without obligation.
10. Trial and paid plans
- 10.1New accounts receive a 7-day free trial with full features. No payment card is needed and the trial does not convert to a paid plan by itself.
- 10.2When a trial ends without a paid plan, the workspace is paused, not deleted.
- 10.3Paid plans are billed monthly in advance. Prices are exclusive of GST, which is charged at the applicable rate. No fee depends on whether you win a tender.
- 10.4Fees, billing and renewals are governed by the Subscriber Agreement.
- 10.5Money-back guarantee: you may ask for a full refund of the plan fee for your current billing period at any time, once per subscriber. GST and payment processing charges are not refundable. We pay the refund within 14 days of your request, to the original payment method through Cashfree. The Refund Policy has the detail.
11. Disclaimers
- 11.1The Service, the tender information and AI Output are provided "as is" and "as available".
- 11.2To the extent the law allows, we disclaim all warranties, including any warranty that the Service lists every relevant tender, that information is accurate or current, that AI Output is correct, or that the Service will be uninterrupted or error free.
- 11.3Nothing in these Terms excludes liability that cannot be excluded by law, including for fraud or wilful misconduct.
12. Limitation of liability
- 12.1We are not liable for indirect or consequential loss, or for loss of profit, contract, opportunity or goodwill.
- 12.2We are not liable for any tender missed, shown late or filtered out, any bid rejected, disqualified or lost, any forfeited deposit or security, or any decision taken on unverified information or unverified AI Output.
- 12.3Our total liability for all claims together is limited to the fees you paid us in the three months before the event giving rise to the first claim. Where you have paid nothing, it is limited to INR 1,000. This is a single cap shared with the Subscriber Agreement.
- 12.4Claims must be brought within twelve months of the date you became aware, or should have become aware, of the facts.
13. Indemnity
- 13.1You will indemnify AveoSoft, its directors and staff against claims, penalties, losses and reasonable legal costs arising from your breach of these Terms, any false, forged or infringing material you upload or submit, any bid you submit and any dispute arising from it, or your breach of law.
14. Suspension and termination
- 14.1We may suspend or end your access if you breach these Terms, if there is a credible security risk, if the law requires it, or if fees are unpaid under the Subscriber Agreement.
- 14.2Where circumstances allow, we will give notice by email first and a chance to fix a breach that can be fixed.
- 14.3You may stop using the Service at any time. To close your account and delete your data, follow the Account Deletion page.
15. Changes
- 15.1We may change the Service. We will not materially reduce the core features of a paid plan during a paid period without 30 days' notice by email.
- 15.2We may amend these Terms by publishing a new version with a new version number and date. Registered users get at least 30 days' notice by email before a material change takes effect, except where law or security requires sooner.
16. Governing law and disputes
- 16.1These Terms are governed by the laws of India.
- 16.2A party raising a dispute will first send written notice and both parties will try in good faith to resolve it within 30 days. Either party may seek urgent interim relief at any time.
- 16.3The courts at Ahmedabad, Gujarat have exclusive jurisdiction.
17. General
- 17.1These Terms, with the Privacy Policy and, for subscribers, the Subscriber Agreement and Refund Policy, are the entire agreement on their subject.
- 17.2If any provision is unenforceable, it is limited to the minimum extent necessary and the rest continues.
- 17.3A delay in enforcing a right is not a waiver. You may not assign these Terms without our consent. We may assign them to a successor business on notice.
- 17.4Neither party is liable for delay caused by events beyond its reasonable control, including outages of the Covered Sources, the internet or cloud infrastructure, other than payment obligations already due.
- 17.5Notices to us go to contact@bidshakti.com or our registered office. Notices to you go to your registered email or appear in the BidShakti portal.
18. Grievances and contact
- 18.1Send complaints about the Service to contact@bidshakti.com with your name, account details and a clear description. We acknowledge within 48 hours and aim to resolve within 15 days.
- 18.2Grievances about personal data are handled by the Grievance Officer named in the Privacy Policy.
